The Fight Begins

In my first post on the Miers nomination, I said, “The real question is whether conservatives will have the guts to put up a fight.”

It looks like they have found their intestinal fortitude.

David Frum links to two anti-Miers websites: www.betterjustice.com and www.withdrawmiers.org. They’ve raised money, produced ads, and are gathering signatures for a petition.

Frum’s post also led me to Tradesports, another futures market trading on the Miers nomination (see their chart below for comparison with the Newsfutures chart). There is a slight difference in that the Newsfutures contracts are time-limited (she has to be confirmed in 2005), while the Tradesports contracts are not.

    This will review how little I have paid attention to the Miers nomination, but what is it about her that the conservative do not like? Do the liberals like her?

    Rex, check out the text of the petition to learn more, but the bottom line is this.

    Conservatives believe that this once-in-a-lifetime opportunity to shift the balance of the Court should not be squandered on a nominee who is not unquestionably brilliant and unambiguously originalist. Miers spent 60 years on this earth without ever opening her mouth or picking up her pen on the subject of originalism until after her nomination.

    By the way, liberals don’t like her either, because she is too pro-life.

    Ex - I understand that you and many convservatives don’t like her because of the whole originalism thing, and you and I have had good say on that issue elsewhere.

    I also can’t speak for other liberals - if I am one - and the abortion issue may have an effect.

    I think your explanation to Rex was a little simplistic, but that’s okay. Here, though, is one more reason not to like Miers. As a big fan of the Rule of Law, I would prefer to have a QUALIFIED Supreme Court Justice, every time, “unambiguously brilliant,” regardless of political stripe.

    In any event, good call on the withdrawal. You called it with aplomb.

    You are right that qualifications should be the first consideration. I also made that point in my first post. If I was simplistic in answering Rex it it was only due to haste. I’m on the plane now and have to scoot. So I have the same problem with this post.

    Another difference is that news futures if not real $ while others are for real money.
